CONTRACT TO ASSUME RISK AND WAIVE LIABILITY
I represent that I am an adult signing on my own behalf or on the behalf of my minor child named ___________________, and that I wish to take riding and horsemanship instruction from Simone Windeler.
I understand that riding horses and working in the stable area has inherent dangers, and that I may be seriously injured, or even killed in a horse related accident. By way of illustration, horse related accident includes being stepped on, kicked or otherwise struck by a hoof, bitten, or fall from a horse.
Simone Windeler has represented to me that she will use reasonable care in the selection of horses she allows me to ride, and in supervising my riding lesson. I understand that Simone Windeler cannot prevent accidents, and I do not expect her to do so. I have been specifically advised that I can expect to fall from a horse in the natural course of learning to ride. If at any time during a lesson I become fearful to the point I wish to dismount, I will so advise Simone Windeler, my instructor.
I hereby specifically release, indemnify and hold Simone Windeler harmless from liability for any claims, which may arise out of my activities on the premises. In signing this contract, I am binding myself, my survivors, or any other person or entity seeking to assert a claim on my behalf or which arises from an accident occurring while riding under Simone Windeler, even if such accident results in permanently disabling injury or death.
I have read this contract, understand it completely, and execute it voluntarily and with full knowledge of its consequences. Please note the addendum due to COVID 19 on page 2.

Addendum for COVID-19
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.
As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Simone Windeler / The Elegant Rider has put in place preventative measures to reduce the spread of COVID-19; however, Simone Windeler cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending a riding lesson or clinic with Simone Windeler could increase your risk and your minor (if applicable)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or my minor may be exposed to or infected by COVID-19 by attending lessons or clinics with Simone Windeler and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Simone Windeler, employees, volunteers, and clinic or lesson participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or my minor (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my minor may experience or incur in connection with my or my minors attendance at lessons or clinics (“Claims”).
On my behalf, and on behalf of my minor, I hereby release, covenant not to sue, discharge, and hold harmless Simone Windeler, The Elegant Rider, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Simone Windeler, The Elegant Rider, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any lesson or clinic.
